Terms and Conditions for Cheers Cultural Tours

"CCT" is the name Cheers Cultural Tours which runs tours to the Czech Republic
"Tour" means any tour organized by Cheers Cultural Tours
"Participant(s)" means any person(s) who have booked on a Tour
Please read the following terms and conditions as they limit CCT's liability and that of the suppliers, carriers, sub-contractors and agents providing your tour services. In addition, they outline the conditions under which your trip will operate.  Your deposit, submission of the completed booking form and acceptance of final tour documents acknowledges and represents an acceptance by the purchaser of the terms and conditions as follows.
Booking a Tour: To register for a Tour, please first read all of the Terms and Conditions on this page as these contain important information. All bookings and travel are made and accepted under the Terms and Conditions set out on this page and will be confirmed only after receipt of a $500 deposit. The full balance of the tour is due 30-45 days before tour commencement. If the balance is not received by the due date, it will be considered as a tour cancellation. If a booking is made within 45 days of the tour commencement, a full payment will be due upon booking the Tour. To authorize a booking, all participants must make a reservation by completing, signing and dating a CCT online form or our printable booking form. At the time of booking, Participants should inform CCT of any special needs, whether dietary, mobility or otherwise and CCT will advise whether the Participants special needs can be accommodated.

INCLUDED IN PRICE:

Accommodations: all accommodations are of the category/class as indicated in the corresponding travel itinerary and are based on two persons sharing a room with private facilities.  Hotel fees and taxes for the room are also included.. CCT has the right to substitute hotels and lodges when necessary. All substitute accommodation will be in the class/category similar/comparable to the original category.
Single Accommodations are available at an additional cost as specified in the itinerary.

Meals: are provided as specified in the itinerary.
Sightseeing/Ground Transportation: Entrance fees to the attractions (castles, museums, breweries and other places of interest) as indicated in the tour itinerary. Ground transportation as specified in the itineraries

NOT INCLUDED IN PRICE:

Air travel: international and national air travel, taxes and fees, airport taxes as well as ground transportation to/from the airport to/from the hotel is not included. Any charges by the airlines for excess baggage and baggage forwarding. Additional expenses incurred due to change, delay or cancellation of any flights or any delays or events beyond CCT's control are the responsibility of the participant. Lost and/or partially unused airline tickets are not refundable, transferable or replaceable.

All discretionary hotel charges, fees and taxes associated with these charges such as fax, telephone, cable, room service, mini-bar, internet, laundry etc. are not included.
Costs of obtaining passports, visas, inoculations, meals not specified in the itinerary, travel insurance (trip cancellation, baggage insurance, medical expenses, medical evacuation, trip delay/missed connection, personal insurance) local airport taxes and tips/gratuities to hotel staff, tour leaders, sightseeing drivers and guides.
Travel Insurance:  We strongly recommend that you purchase comprehensive travel insurance policy which covers trip cancellation, baggage insurance, medical expenses, medical evacuation, trip delay/missed connection, personal insurance. Travel insurance is available from a third party to provide coverage for cancellation fees, medical/accident expenses, loss of deposit, lost or delayed baggage or other travel-related losses. Adequate travel insurance should cover medical expenses (such as emergency treatment, hospitalization, medical evacuation) caused by illness or accident prior to or during the tour and loss of funds through cancellation and curtailment of the trip for insurance reasons. We assume no responsibility for any medical expenses that may arise as a result of illness or accident on the participant's part.
Passports, Visas, Tour Documents and Vaccinations: A passport is required of every CCT tour participant.  This passport must be valid for at least six months beyond the day you plan to finish your trip. Any visas and inoculations, if needed, are the sole responsibility of the tour participant. Your tour documents will be sent approximately two weeks before departure
Fitness, Health and Participation: All participants are expected to be in a reasonably good health and able to complete their selected tour as outlined in the itinerary prior to booking.  By submitting the registration form and sending the deposit, the participant acknowledges that he or she does not suffer  from any physical disability that would create a hazard for themselves or other tour participants.  CCT  reserves the right to decline a booking to any person should the presence of that person jeopardize safe and enjoyable operation of the tour or be conflicting/discordant with the local laws.  (at their discretion). During the tour, participants agree to respect the decisions of CCT tour leaders and employees who have the right to exclude the participant from the tour at the client's sole expense (i.e.no refund given) if the conduct, health or mental condition of a participant could create a hazard to himself or others or otherwise impede the safe and enjoyable progress of the tour. In addition, we assume no responsibility for any medical expenses that may arise as a result of illness or accident on the participant's part.

Cancellation Policy:

By the Participant: If participants need to cancel their booking on any Tour, they must give written notice to CCT prior to the departure date of the Tour. Cancellations should be made by email if possible.

If the cancellation is received more than 60 days prior to departure any monies paid by the Participant will be refunded to the Participant less a $75 cancellation fee

If the cancellation is received between 30-59 days before departure the $500 deposit will be forfeited

If the cancellation is received between 15-29 days before departure (i.e. after final payment), refunds will be based on recoverable expenses, i.e. according to supplier and service provider contracts and obligations

If the cancellation is received less than 14 days before departure the charge will be 100% of the cost of the Tour.

Refunds will not be made for occasional missed meals or for any absence from the tour, or for transportation or hotel accommodations not utilized

By CCT: CCT runs Tours for groups of 10 to 15 people. If less than 8 people book on a Tour it may not be viable for the Tour to proceed and CCT reserves the right to cancel a Tour due to lack of sufficient numbers to make the Tour viable. CCT would endeavour to give a Traveller at least 28 days notice of any cancellation and any monies paid for the Tour will be repaid in full. In the unlikely event we have to cancel a trip for any other reasons than stated above your payment will be fully refunded. Should this happen, we will endeavor to provide you with an alternative trip option, if such option is available. CCT cannot consider any other claims from the participant.
In the event of cancellation by either party, CCT will not be liable for any other costs incurred beyond the cost of the Tour or arising from that cancellation and CCT requires participants to obtain appropriate travel and cancellation insurance

Adjustments: Tour Itinerary: CCT will make best efforts to operate the tours as advertised on the website. However, depending on the prevailing conditions, CCT reserves the right to withdraw any tour or a portion of a tour, to make alterations to the itinerary (including transportation, accommodation or other arrangements) as it deems necessary or desirable for the comfort of the tour participants and to substitute alternative arrangements of comparable value without compensation and accepts no liability for loss of enjoyment as a result of these changes. If a change is necessary CCT will inform the participant as soon as possible if there is time before departure. By making the deposit or payment to CCT, the participant accepts the aforementioned terms and conditions.
Pricing: Prices are in U.S. dollars unless otherwise stated and are based on international tariffs of the country for which the itinerary is planned. These tariffs are subject to currency fluctuations, changes in local taxes both here and overseas and increases by suppliers. CCT reserves the right to amend prices should we incur severe currency fluctuation, increased taxes or any other relevant factors that may result in additional charges until paid in full. CCT cannot make reimbursements or refunds for price differences due to local specials and local or domestic discounts. Acceptance of this arrangement is a condition of booking. 
Responsibility/Liability: CCT, operators of the tours and /or subcontractors of services act only as agents for the supplier in regards to travel, whether by aircraft, car, bus or van, boat, rail, any type of public transportation or bicycle and assume no liability for injury, damage or loss to person or property, accident, delay or irregularity, which may be caused either by reason or defect of any vehicle, weather, act of war, insurrection, revolt or other civil uprising, other military action, strikes, theft or any Act of God occurring in either the country of origin, destination or through passage, or for any reason whatsoever, or through the acts of default of any company (including but not limited to transportation and hotel services)  or persons  engaged in arrangements of the tour. In addition, CCT is not liable for provision of medical care or of any care that may be supplied/delivered. While participants engage in the tour activities, they are aware of the risks of consuming alcohol and therefore agree to accept any risks and responsibility for their own safety, well being and health. CCT is not responsible if the participant engages in excessive drinking or dangerous activities and suffers injury, illness, death, loss or damage as a result or causes such injury, illness, death, loss or damage to a third party as a result (including another tour participant). CCT cannot accept any responsibility for losses or additional expenses due to delay or changes in schedules or other causes.  All such losses or expenses will be the responsibility of the member of the tour, as the rates provided are for the arrangements only at the time stated.  Participants accept all such risks associated with participating in this tour. CCT may not be held responsible for any loss or damage to luggage, before, during or after the tour.
The tours operated by CCT are designed to provide participants with an exposure to the true nature of the environment visited and therefore involve exposure to potential hazards over and above those associated with normal tours. CCT regularly includes visits to working breweries which contain commercial equipment and installations.

Participants may be required to walk among machinery, hot pipes, boiling kettles, vehicles, bottling plants. Participants are also aware that beer tastings are part of the brewery tours/visits and that they may be required to walk through steep/narrow stairways and corridors (prior or following the tasting) which poses additional hazard and risk during the visits. Participating in the tour will also involve taking trains, subway/metro, tram, public bus and taxi. Additionally, participants will be walking on and crossing busy streets and platforms at railroad, subway/underground, and tram stations and climbing stairs in the hotels, castles, restaurants, bars, and pubs as well as stairs in the buses, trains, subway, and trams, which poses hazards and risk. All bookings are accepted on the understanding that such risk and hazards are appreciated by the participant and that they undertake all tours and other activities at their own volition and at their own risk.
The participant accepts these risks and takes full responsibility for their own health, well-being and conduct during the tour. Participant further agrees not to hold CCT, the brewery, or any other service provider/supplier responsible/liable in case he or she suffers any illness, bodily injury, emotional trauma, death and/or property damage or any harm as a result of taking CCT tour.

Additionally, participants are responsible for carefully reading and understanding the details outlined in the tour itinerary and in the travel documents (containing additional information about the tour) which will be sent before the commencement of the tour.
AS LAWFUL CONSIDERATION for the agreement with CCT, to participate in such trips and activities you hereby agree that you will not make a claim against CCT, or sue for bodily injury, emotional trauma, death and/or property damage, however caused, as a result of your participation in your pre-arranged tour. You therefore release CCT, and its employees from any and all claims, known or unknown, arising from your participation in a tour.

This release of Liability and Assumption of Risk agreement is entered into on behalf of all members of your family, party, or group.  This agreement is binding on your heirs, legal representatives and assigns. If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect.

Any payment to CCT constitutes your acceptance of the terms and conditions set out herein.
